CANNADROP TERMS AND CONDITIONS

 

THE FOLLOWING ARE THE GENERAL TERMS AND CONDITIONS WHICH REGULATE THE ACCESS, USE, REGISTRATION AND PERFORMANCE OF COMMERCIAL TRANSACTIONS ON THE GOODS AND SERVICES OFFERED BY GAMMA INVERSIONES SAS WITHIN OR THROUGH THE WWW PORTAL. CANNADROP.COM.CO AND THE MOBILE APPLICATIONS MANAGED BY IT (HEREINAFTER THE "PORTAL") AND/OR OTHER DOMAINS OR PORTALS RELATED TO CANNADROP

 

GAMMA INVERSIONES SAS. is a commercial company legally created under the laws of the Republic of Colombia, which for all purposes of this document shall be called "CANNADROP". Any person who registers in the Portal and/or carries out a commercial transaction in it, declares that he/she knows and accepts each and every one of the provisions established in these Terms and Conditions. Consequently, all acts and contracts celebrated in or through the Portal will be subject to the provisions contained in this document and in the applicable Colombian legislation in force.

The present Terms and Conditions will refer as the "Client(s)" jointly to the visitors of the Portal, the potential buyers and the purchasers. Any person who does not accept these Terms and Conditions and the Data Processing Policy of GAMMA INVERSIONES SAS, which are mandatory and binding, must refrain from using, accessing, registering or performing any act of commerce in or through the Portal.

1.     CUSTOMER REGISTRATION ON THE PORTAL

The purpose of registration in the Portal is to allow the Customer to register, access, use and carry out commercial transactions through the Portal. The Customer has two (2) options to register:

 

  • Sign up through third party applications, such as, but not limited to Facebook, Google, Instagram or LinkedIn ("Third Party Applications"). In this case, the Customer authorizes and understands that GAMMA INVERSIONE SAS may collect other information that is available in its account(s) registered in the Third Party Applications, such as but not limited to first and last name, profile photo(s), country and city of residence, e-mail, telephone and date of birth, among others; the Customer declares to understand and accept that the Third Party Applications have their own terms and conditions of use and privacy policies without GAMMA INVERSIONE SAS. has any interference with them, or with the characteristics, activities, advertisements, behavior and/or content published, much less with the transactions that the Client may carry out through said Third Party Applications.
  • Registering directly through the Portal, where the basic personal data of the Customer will be requested, including, but not limited to: (i) name and surname(s); (ii) citizenship card or identification number; (iii) date of birth; (iv) gender; (v) e-mail address; (vi) password. In case the Customer makes a purchase, he/she must also provide, among others, (i) address, municipality and department; (ii) fixed and/or mobile phone

The Customer, when entering his data, declares under oath that the same correspond to true and valid information. GAMMA INVERSIONES SAS is not responsible for the accuracy of the personal data provided by the Clients.

Each Client may only hold one account in the Portal. In the event that GAMMA INVERSIONES SAS proves that an account or registration is being used for fraudulent or undue purposes or that it contravenes good faith and/or good customs, or if it cannot confirm the origin of the account or registration, GAMMA INVERSIONES SAS shall be entitled to eliminate or suspend the registration in the Portal, as well as to initiate the necessary legal actions.

Access, use, registration and commercial transactions carried out through the Portal must be carried out by persons of legal age.

Client registration data will be collected, stored and used by GAMMA INVERSIONES SAS in accordance with GAMMA INVERSIONES SAS' Personal Data Processing Policy published at the following link https://cannadrop.com.co/politica-de-datos/ Only those persons who have the legal capacity to contract and commit themselves, that is to say, those persons over eighteen (18) years of age, may access, use, register or carry out any act of commerce in or through the Portal.

Consequently, with the registration the Client declares and certifies that GAMMA INVERSIONES SAS is not responsible for the information provided by its Clients including their date of birth and identification number, among others.

If any operations and/or transactions are carried out by minors, they shall be understood to have been carried out under the responsibility of their parents and/or guardians. The realization of the purchases in the Portal will require, according to the means of payment selected, the supply of financial information, including specific information of the credit or debit card, telephone and shipping address. GAMMA INVERSIONES SAS does not store or keep any information related to the Client's bank details or financial information.

GAMMA INVERSIONES SAS reserves the right, at any time, to (i) Contact and request additional information in order to corroborate personal data; (ii) Temporarily or definitively suspend the purchases of those Clients whose data have not been confirmed, are suspicious or are identified as possibly fraudulent; (iii) Delete any previously accepted record; (iv) Reject any new request, without being obliged to communicate or explain the reasons for its decision, and without this generating any right to compensation or indemnification in favor of the Client.

  • SECRET KEY

Once registered in the Portal, the Customer must enter the secret key that has been assigned to him to access his account and / or to make purchases. This will allow the Customer personalized, confidential and secure access to the Portal. The secret password is personal and non-transferable, which is why all operations carried out from the account are and will always be the absolute responsibility of the Customer. GAMMA INVERSIONES SAS shall

not be liable for the delivery of the Secret Code to third parties or its use. The Client will have the possibility of changing the password at any time, for which they must follow the procedure established in the Portal. In the event that the Client becomes aware of any access and/or improper use of its account by a third party, it must immediately notify the GAMMA INVERSIONES SAS Client Service area, through any of the service channels provided: SERVICIOALCLIENTE@SAVANNACARE.COM.CO or telephone in Colombia. 3174353911.

 

1.2.   PROCEDURE FOR USING THIS PORTAL

The Portal informs you of the steps to be taken to purchase products through the Portal, as well as the different service channels available to identify, update and correct your data, in accordance with the data processing policy of GAMMA INVERSIONES SAS.

The use of bank cards accepted in the Portal is subject to the contract between the Client and the issuing Bank, without GAMMA INVERSIONES SAS having any responsibility or interference in relation to the aspects indicated in the same. The information on your bank accounts, credit cards and debit cards are managed exclusively by the third parties that provide this service for GAMMA INVERSIONES SAS, without GAMMA INVERSIONES SAS having any responsibility for the management, operation and/or storage of the same. Any claim regarding the use and payment through bank cards must be made directly to the indicated third party.

In the event that GAMMA INVERSIONES SAS identifies that the Client is making improper or undue use of the Portal, such as, but not limited to, two or more repetitive cancellations, fraud, among others, regardless of the means of payment used, GAMMA INVERSIONES SAS shall have the power to block the Client, without the latter having the power or right to request any type of compensation for such situation. When the Client has any doubts or concerns regarding

the purchase process on the Portal, he/she may contact the customer service channels, which will provide support and help.

 

2.    FORMATION OF CONSENT TO PURCHASE

The consent by the Customer is manifested with the completion and acceptance of each of the steps of purchase of the Portal and is perfected with the final statement of purchase after having reviewed the summary of the order in which are detailed each of the products, their individual price, shipping costs (if applicable), the others that are in charge, and the total sumatoria that the Customer must cancel. At the time of placing the order, GAMMA INVERSIONES SAS will issue a confirmation and acknowledgement of receipt of the order to the e-mail address provided by the Customer at the time of registration.

 

3.    PROMOTIONS

3.1.   Promotional or advertising communications

The Client expressly authorizes GAMMA INVERSIONES SAS and/or its suppliers, linked or related, to send newsletters to the e-mail address registered in the Portal, which may include promotions in accordance with the characteristics of each Client, according to the purchases made and links visited, in accordance with the authorization given when registering in the Portal. The Customer may request the suspension of any promotional or advertising communication sent to their e-mail address by sending a request to that effect to SERVICIOALCLIENTE@SAVANNACARE.COM.CO.

 

3.2.   Use of Coupons

GAMMA INVERSIONES SAS may at any time issue discount coupons to promote the acquisition of the Products marketed through the Portal. The use of a discount coupon is not cumulative with other promotions or discounts unless otherwise stated therein; it is not transferable to third parties, nor can it be exchanged for money or other products, and may only be used once by each Client registered on the Portal. The discount coupon will indicate the effective date, and other conditions that apply, such as, but not limited to: duration, conditions, selected products, minimum purchases required, among others. The use and application of discount values described in the coupon are 100% subject to the correct use of the same, that is, before completing the purchase the user must click on the button "USE COUPON" so that the discount is applied in the respective purchase. If the coupon is used correctly, the value of the discount will be reflected in the shopping cart. No coupon will be redeemable or refundable by cash, check, credit or debit card, and in general by any other means of payment, notwithstanding the provisions of paragraph (i) below. In the event that the Customer uses the coupon and then proceeds to exercise the right of withdrawal on the product purchased, will apply to one of the following options, as appropriate:

 

  • If the coupon was created for a particular Customer and for their exclusive and personal use, they will be issued a new coupon to be used in another purchase, under the same conditions as the initial coupon.
  • If the coupon was created for the general public, for all or a special segment of the Customers who are already registered, for advertising purchases on the mobile applications, i.e. it was not created for

a particular Customer, the coupon will expire with its use on the first purchase and consequently will not be redeemable again.

 

3.3.   Term and Conditions of Promotions

The offers and/or promotions will be valid as indicated and communicated to the Client. If they are subject to inventory availability, it will be understood that the promotion extends until the inventory for that offer is exhausted or until the effective date indicated for the same, whichever comes first. Promotions cannot be accumulated with other promotions or discounts unless otherwise specified on the Portal or promotion. When the Customer uses the coupon or redeems it (by CLICKING on the "USE COUPON" button) the offers or promotions are accepted in full the conditions to access these and the present Terms and Conditions.

 

4.    INTELLECTUAL PROPERTY

The intellectual property rights to the Portal and especially the content published therein are the exclusive property of GAMMA INVERSIONES SAS or have been licensed to it by its third party suppliers and/or allies. The reproduction, copying, alteration, modification, dissemination, total or partial reuse of all material published on the Portal is expressly prohibited without the prior express written authorization of GAMMA INVERSIONES SAS.

 

5.    PRODUCTS

5.1.   Colours

GAMMA INVERSIONES SAS has made its best effort to ensure that the colours of the products shown in the photos are as close to reality as possible. However, the colour of the products may change or vary due to factors such as light, contrast, the quality of the computer monitor on which they are displayed, among others. GAMMA INVERSIONES SAS cannot guarantee that the colours displayed on the Portal correspond exactly to the colours of the products.

 

5.2.   Exhausted inventories

The Client declares that he/she understands and accepts that between the time when the Product is selected on the Portal and the time when the transaction is actually accepted by the respective financial institution, the selected product may be sold out. For this reason, GAMMA INVERSIONES SAS is entitled to return the transaction and consequently refund the money paid for the sold out product, in the event that such a situation arises. If such a situation arises, GAMMA INVERSIONES SAS shall proceed to inform the Client of the situation in a timely manner, without it giving rise to any responsibility on the part of GAMMA INVERSIONES SAS, or the power to request compensation for damages on the part of the Client.

 

5.4.   Pricing

All product prices published on the Portal are expressed in Colombian pesos and correspond to the unit price of each product. They do not include additional shipping costs, or any other additional expenses.

The additional expenses, such as taxes or shipping caused by reason of the purchase, will be indicated and informed in the Order Form, prior to the acceptance of the Order Form.

  • Strikethrough prices When the Portal shows a price crossed out on the products and another sales price is indicated instead, this price crossed out corresponds to the price that the product previously had, and the price that is not crossed out corresponds to the new price that the Client must pay. The crossed-out price shall always be higher than the new price offered by GAMMA INVERSIONES SAS, and if it is not, the Client shall only be obliged to pay the one that is lower than the two prices indicated. The crossed-out price shall be published so that the Customer may prove the decrease in the initial sales price of the products made by GAMMA INVERSIONES SAS for mere
  • Prices of products sold by GAMMA INVERSIONES SAS under the Retail modality The prices of products sold directly by GAMMA INVERSIONES SAS shall only be valid and applicable in this modality, and shall not be applicable to other sales channels of the "Associated Stores"; nor to the products offered under the Marketplace modality (see "TERMS AND CONDITIONS MARKETPLACE MODALITY PRODUCTS SELLED BY THIRD PARTNERS - ASSOCIATED STORES"), nor to the physical sales, telephone sales, catalogue sales or other website. Below the description of each product it is always indicated who is the supplier and responsible for the delivery of the

5.4.3 Typographical errors GAMMA INVERSIONES SAS markets its products through the Portal which is defined as a technological platform; in this sense it is likely that due to system errors or typographical errors an incorrect price may be presented. The Client declares that he/she understands and accepts that in the event that the above occurs, GAMMA INVERSIONES SAS will inform him/her of this circumstance and may cancel the purchase order(s) containing the product(s) whose price(s) is/are incorrect, and proceed to refund the money for this concept.

5.5  Shipping and Delivery

  • GAMMA INVERSIONES SAS markets its products through the Portal which is defined as a technological platform; in this sense it is likely that due to errors in the system or typographical errors an incorrect price may be presented. The Client declares that he/she understands and accepts that in the event that the above occurs, GAMMA INVERSIONES SAS will inform him/her of this circumstance and may cancel the purchase order(s) containing the product(s) whose price(s) is/are incorrect, and proceed to refund the money for this

5.5.2.  In case the payment of the Product is against delivery, it is the Customer's obligation to pay in cash or by dataphone before receiving the Product. It is the Customer's obligation to inspect the Product immediately after delivery.

In the event that the Client detects that the packaging of the Product(s) is deteriorated or opened, he/she must proceed to open the same and check the condition of the Product(s), and leave a written record of this situation in the presence of the official of the company providing the transport service of GAMMA INVERSIONES SAS. Similarly, in the event of any defect or damage to the Product, the Customer must contact the customer service area and inform them of the situation and deliver and make the product available to GAMMA INVERSIONES SAS without the product having been uncovered, opened or damaged.

  • Once the Client or the person designated by the Client, such as the domestic employee or the guard of the building or residential complex, has received the Product, GAMMA INVERSIONES SAS shall not be liable for the loss or destruction of the Product
  • If the delivery of the Product is delayed: i) Because the Client refuses to receive it without any justification; ii) Because it has not been received within two (2) weeks from the first attempt of delivery by the transport service company or; iii) Due to the inability of the transport service company to find the address that has been mistakenly supplied by the Client, GAMMA INVERSIONES SAS may (without prejudice to exercising any other right or remedy available) not deliver the Product and consequently notify the Client that the order has been cancelled due to non-delivery, in which case the Client shall be refunded the full amount
  • The cost of shipping the Product will be established depending on the city or municipality where the Customer wants to receive the Product, the value to be paid for the products, and the type of delivery service he chooses. This value will be informed to the Customer in the summary reflected in the shopping cart at the time of making the transaction on the Portal. The

delivery service has a cost as long as the purchases are less than $200,000 and this will depend on the location of the address provided by the Customer, depending on the municipality or city where it is located. If the purchases are equal or greater than $200,000, shipping is totally free for the locations defined by GAMMA INVERSIONES SAS The Customer can see the table of shipping prices per city in the following link http/:servientrega.com/wps/portal/Colombia/transactions-persons/tariffs Table of costs per city.

  • The shipments of the products, no matter which, can take up to 24 to 72 hours to reach the customer, depending on the place of shipment nationwide. The customer knows and accepts these
  • Product shipments by GAMMA INVERSIONES SAS. will only be carried out at a national level.

 

 

 

6.    INVOICE

The sales invoice with the detail of the transaction made by the Client will be issued and sent in electronic format to the e-mail address with which it was registered in the Portal, through the supplier authorized by the National Tax and Customs Administration (DIAN). Additionally, it can be downloaded directly by the Client from the Portal by entering his account in "My Orders".

 

7.    RIGHT OF WITHDRAWAL POLICY FOR CHANGES IN PRODUCTS AND REVERSAL OF PAYMENT

7.1.   RIGHT OF WITHDRAWAL

The "RIGHT OF RETRACT" shall be understood to mean the right of the Client to terminate the contract, repent or withdraw from it within forty-five (45) calendar days from the delivery of the Product, within which time the Client must inform and return the products acquired from GAMMA INVERSIONES SAS. The Right of Withdrawal does not apply in the case of goods for personal use, such as underwear, swimsuits, girdles, stockings, hair accessories, perfumes, creams (including hair products), cosmetics, earrings and jewelry. Likewise, the Product must not show signs of use, dirt or wear, or be damaged or deteriorated.

 

  • Conditions for the reimbursement of money If the Product to be returned was paid for by debit card, the full amount of the money actually paid will be refunded by: i) bank transfer (to the bank account informed); ii) if the payment was made by credit card, the refund will be requested from the card issuer so that the Client will receive the money discounted from its statement; iii) if the payment was made on delivery, the Client must inform the bank account to which the money can be refunded. In the event that the Client does not have a bank account, GAMMA INVERSIONES SAS will reimburse the money through Efecty. The refund of the money by bank transfer, in cash through Efecty, will be made within thirty (30) calendar days following the date on which GAMMA INVERSIONES SAS receives the Products returned to its warehouse in the same conditions in which they were delivered to the Client. GAMMA INVERSIONES SAS will verify that the right of withdrawal has been exercised in the term and conditions specified in these General Terms and Conditions, so that it is accepted. In cases where the return is made to a bank account or through Efecty the return will be made in the

name of the person who made the purchase. No refunds will be made in the name of third parties, in order to avoid fraud.

If the client decides to request a refund by a different means of payment than the one used originally, he must inform us at the time of making the request, including at least the information and / or data necessary to make such a refund. In case the Client decides to request the delivery of a voucher for the value of the products on which he exercised the return, the same will be sent to his email within a period of six (6) working days, and may be used from that moment and up to six (6) months after its receipt. In the event that the term committed to make the delivery of the Product is not fulfilled or when the Product delivered does not correspond to the one requested, the Client will have the right to request the resolution or termination of the contract, and to obtain a full refund without any retention or discount.

 

  • Process: If the customer wishes to return the product for reasons written in this document of Terms and Conditions, must make the request to the email servicioalcliente@savannacare.com, to begin the

 

7.2.   REVERSAL OF PAYMENT

The Customer may request that payment for a product purchased on the Portal be reversed directly when the product purchased is not received, or the product delivered does not correspond to what was requested or is defective. If the Client detects that a fraudulent operation has been carried out, that is to say, that an order has been charged to his/her credit or debit card in the name of GAMMA INVERSIONES SAS, he/she must contact his/her bank that issued the card to report the event so that, through the processes of the bank, the corresponding money can be refunded, if he/she considers this after making the corresponding investigations of the case.

 

7.2.1 Procedure: To request a reversal of payment, the Customer must notify the GAMMA INVERSIONES SAS customer service area within five (5) working days from the date on which it should have received a Product and did not receive it; the date on which it received a defective or non-conforming Product.

In the latter case, the Client must return the Product in accordance with the procedure established to exercise the right of withdrawal. In

both cases, if the payment was made with a credit card, GAMMA INVERSIONES SAS will request the reversal of the payment to the intermediary that provides the service. If the purchase was made with a debit card or other electronic payment method other than credit card or under the cash on delivery method, the money will be returned via bank transfer (to the bank account you inform us of). In the event that the Customer does not have a bank account, GAMMA INVERSIONES SAS will refund the money through Efecty. In cases where the refund is made to a bank account or through Efecty the refund will be made in the name of the person who made the purchase. No refunds will be made in the name of third parties, in order to prevent fraud. Likewise, the notification of the situations described above to the Customer Service area of GAMMA INVERSIONES SAS does not exempt the Customer from the responsibility of notifying the claim to the issuer of the electronic payment instrument used to make the purchase.

When the payment corresponds to several products, the Customer may request the partial reversal of the payment of those for which the request is made. In this case the Customer must clearly state which Product and the value for which he is requesting the reversal. Once the Client notifies GAMMA INVERSIONES SAS of the reversal request, GAMMA INVERSIONES SAS must notify the intermediary provider of the electronic transaction processing so that they immediately notify the issuer of the payment instrument. The card issuer's times to reflect the reversal of the payment on its statements may be delayed and are beyond the responsibility of GAMMA INVERSIONES SAS.

7.3.   WARRANTY

Unless otherwise indicated on the Portal in relation to a particular Product, as a general rule, the products sold there will be guaranteed for nine (15) calendar days from the date of receipt of the Product by the Customer.

All Products sold on the Site have a Limited Quality Guarantee for the term indicated above. In order to make the Warranty effective, it is the Client's obligation to fully comply with all the conditions and requirements indicated in the section "CHANGE POLICY" set forth in these Terms and Conditions. GAMMA INVERSIONES SAS shall have the right to repair or replace the good, or return the money paid for the product. The new product for warranty purposes shall be sent to the Customer at the address provided in the registration or at the place indicated in writing to the Customer Service area of GAMMA INVERSIONES SAS. In case of guarantee, the Product will be replaced by an identical one or one with similar characteristics; or a bonus or money refund will be generated to the Client, according to what the Client decides. In no case may the characteristics of the Product be inferior to those of the good that gave rise to the guarantee and its shipping will be assumed by GAMMA INVERSIONES SAS. If it is decided to replace the good with another one of the same or one with similar characteristics, the change will be made within ten (10) working days following the date on which the product being changed is received at GAMMA INVERSIONES SAS' warehouses, and the term of the guarantee will begin to run again. In the case of money returns, GAMMA INVERSIONES SAS has up to fifteen (15) working days from the acceptance of the guarantee to make the refund. The acceptance of a Guarantee will depend on the category to which the product belongs. Below is a list of the cases in which the guarantee operates and does not operate according to each category:

 

  • Cannabis Oils: No warranty reasons: Rips, scratches, breakage of materials (packing box), deformation of materials, as well as parts that make up the product such as drip box and drip
  • Cannabis Ointment: No warranty reasons: Rips, scratches, breakage of materials (packing box or can), deformation of materials, as well as parts that make up the product such as can, box and

 

7.4.   CHANGE POLICY

The change policy operates in two (2) events: (i) the first one, in case the Customer acquires the Product and the size chosen is not in accordance with the Customer's needs and; (ii) the second one, in case a product with quality or suitability defects is presented that allows to request the product warranty or the legal warranty as the case may be.

 

  • Changes : The Product to be changed must be unused, with labels in perfect condition and must have the original packaging. Thus, the Customer will have a term of forty-five (14) calendar days from the delivery of the product to request the change of it, following the indications referred to in point 4.3.
  • Change in quality and suitability Defects in quality or suitability, i.e. manufacturing, processing and/or not entirely suitable for the intended use, are required for warranty changes to be

Portal, products sold directly by GAMMA INVERSIONES SAS shall be guaranteed for ninety

(15) calendar days from receipt of the Product by the Client.

To request the effectiveness of the guarantee, the Client must contact the Customer Service area (telephone, chat or e-mail) and report the damage to the Product and make it available to GAMMA INVERSIONES SAS within fifteen (10) working days from the date on which the guarantee request is notified. Once the warranty request has been

received, GAMMA INVERSIONES SAS will generate the reverse guide for the Product to be delivered to the Servientrega service points ready for collection and will send it to the Client's

e-mail address registered on the purchase order or informed at the time of the request. The customer may also request, if possible due to his address, that the product be collected from the address indicated.

  • Procedure The Client must enter the web portal https://cannadrop.com.co and follow the steps mentioned there. GAMMA INVERSIONES SAS has two (2) modalities for the return of Products: (i) The Client must leave the Product at any of the Servientrega offices, following the procedure set out below, or; (ii) Request that the product be sent to GAMMA INVERSIONES SAS. In both cases the Product must be in its original packaging, sealed and in the same condition as it was delivered. Regardless of the return method chosen, the Client must return the product to be exchanged to GAMMA INVERSIONES SAS' warehouses, at the latest within fifteen (15) working days following the date on which the request was made. Failure to do so shall be understood as a withdrawal of the change
  • Ways in which the change is to be made The forms of change contemplated by GAMMA INVERSIONES SAS are Exchange for the same product, exchange by coupon or money

8.    DATA PROCESSING POLICY

The PERSONAL DATA PROCESSING POLICY OF GAMMA INVERSIONES SAS. is

published at the bottom of the home page of www.cannadrop.com.co or by clicking here. Likewise, in relation to GAMMA INVERSIONES SAS. Data Processing Policy, the Client declares to understand and accept that once registered in the Portal and/or the mobile application, he/she accepts to receive offers by e-mail and the Data Processing Policy. There are several ways to receive communications from GAMMA INVERSIONES SAS, such as, but not limited to: advertising campaign emails, transactional emails, birthday emails, text messages, push notifications (messages issued by the mobile application), among others.

Consequently, in the event that a Client "unsubscribes" in order not to receive any further communications from GAMMA INVERSIONES SAS or requests the deletion of his/her personal data, the Client declares that he/she understands and accepts that GAMMA INVERSIONES SAS will deactivate his/her data or delete them as appropriate.

 

9.    MODIFICATIONS AND SURCHARGES
